On Wednesday, May 5, 2011, Peter Simone, age 48, and Kimberly Kirkby, age 50, were arraigned at 55th District Court in Mason. Each was charged with the following crimes:
• 1 Count Criminal Enterprise
• 2 Counts of Uttering and Publishing, a 14 year felony per count
• 1 Count of Receiving and Concealing Stolen Property
• 13 Counts of Retaining a Financial Transaction Device without Consent of
Owner, a 4 year felony per count
• Simone is being charged with Habitual Offender 3rd Offense
• Kirkby is being charged with Habitual Offender 2nd Offense
The Magistrate has set Simone's bond at one million dollars and Kirkby's bond was set at $75,000 cash. The next court appearance is scheduled for May 19, 2011, at 55th District Court for a preliminary exam.
